Plaintiff-appellant Treasa M. Rhoads resigned from her position as a school bus driver for defendant-appellee Board of Education of Mad River Local School District (“District”) on April 15, 1999, after failing a random drug test administered by the District. Rhoads attempted to reacquire her position on several occasions, but the District refused to rehire her. She subsequently filed suit against the District and defendant-appellee Alex J.
