On September 12, 2006, plaintiff Dorothy A. Wendel, individually and as a class representative for all others similarly situated (“Wendel” or “plaintiff’), brought the instant action against defendants State of New York (“New York”), New York State Department of Motor Vehicles (the “DMV”), and Nancy A. Naples, in her official capacity as Commissioner of the Department of Motor Vehicles (collectively, “defendants”).
