DIBELL, Justice.

Action on an insurance policy of $1,000 issued by the defendant on the life of Emmett A. Elness. The plaintiff, his Avife, Avas the beneficiary. The policy, in addition to insurance on life, promised the insured disability benefits. The plaintiff sought a recovery of them. • Before the close of the testimony, conceiving that disability benefits could not be recovered by her and that the cause of action therefor Avas in the personal representative of the deceased, she Avithdreiv her claim for them.
