This is an action by F. L. Richmond and W. T, Wright against E. McNeill, as receiver of the Oregon Railway and Navigation Company, a corporation, to recover damages for injury to land belonging to them in Union County, Oregon, by the barning of the soil thereof and the grass, fence posts, and wire thereon, the destruction of which is alleged to have been caused *347by the negligent operation of a railway locomotive on tbe line of said company, whereby sparks were emitted therefrom, which, falling upon a quantity of dry grass and other inflammable material,…
