On April 30, 1945, the County Court for Umatilla County admitted to probate, as the last will and testament of Alice Perry, deceased, a written instrument dated July 30, 1941, and appointed Ernest C. Allen as executor thereof. On May 4,1945, Bessie Breding filed in said court her petition contesting the purported will, and offering for probate, as the last will of said Alice Perry, a written instrument, in due form, dated August 5,1941.
