This is an appeal by the contestant of a will from an order admitting that will to probate after trial of a will contest before the court sitting without a jury.

Laura Schwartz, the deceased, lived at Los Angeles, where she- died on December 18, 1942, at the age of seventy-four years. Her sole surviving heirs at law were two sons, Harold I. Schwartz and Bernerd Schwartz. Both sons were married and living with their wives. Phyllis Schwartz is the wife of Harold I.
