On January 3, 1931, the People, on the relation of James M. Weaver and Bert Weaver, filed in the circuit court of Mason county a verified petition asking that leave be granted to the State’s attorney of that county to file an information in the nature of quo warranto questioning the right and authority of appellees, Zealy M. Holmes, Ora J. Coon and Thomas F. Schaad, to hold and execute the offices of commissioners of the pretended Sangamon Outlet Drainage District of the counties of Mason, Menard and Cass.
