MEMORANDUM OPINION

ZIRPOLI, District Judge.

INTRODUCTION

Norman Lloyd Petersen, plaintiff herein, seeks in effect a declaratory judgment that he was not under a lawful duty to report for induction into the armed forces of the United States on January 25,1968.
