Plaintiff, as the Commissioner of Finance, filed petition in two counts to recover from defendant school district the sum of $3948.46. The first count is for money had and received and the second count is on the theory of conversion. The cause was tried before the court without a jury. The finding and judgment Avent for defendant and plaintiff appealed. The commissioner of finance in AA'hose name this cause was instituted has been succeeded in office by another, but no substitution has been suggested.
