Goodwin v. T.J. Schimmoeller Trucking, 16-07-08 (1-22-2008)
Ohio Court of Appeals
1Opinion of the Court
OPINION
{¶ 1} The plaintiff-appellant, Michael J. Goodwin, appeals the judgment of the Wyandot County Common Pleas Court dismissing his complaint against the defendants-appellees, T.J. Schimmoeller Trucking, Inc. and Ted Schimmoeller, based on the applicable statute of limitations. On appeal, Goodwin contends that he refiled his complaint six days late; however, he argues that the defendants were outside the state of Ohio for nine days, thus tolling the statute of limitations under the savings statute. For the reasons expressed herein, we affirm the judgment of the trial court.
