Affirming.
The appellee, Aun Marshall, brought this suit on a note 'ag’ainst S. A. Anderson. He answered admitting the note, hut set forth that the administrator of Martha Ann Marshall, and the children and heirs of Martha Ann Marshall were setting up some claim to it, and asked that they he made parties, and assert their claim, and that the court determine to whom the note belonged, and that a judgment he rendered against him in favor of the party who was entitled to collect it, for his protection.
