Milled, Judge:
By their original and amended bills, plaintiffs, William C. and H. IJ. Bond, sought to establish, and have decreed to them a two thirds undivided interest in the timber on a tract of 8,467!: acres in Pocahontas county.
The title to this land is in the defendant, the Harpers Perry Timber Company, á corporation, organized by the defendant, W. S. Taylor, and four personal friends associated' with him, each subscribing for one share of stock, par value of one hundred dollars each, and so far as the record shows constituting the entire amount of capital stock subscribed.
