DOTY, District Judge.

This matter is before the court on defendants’ motion for summary judgment. Based on a review of the file, record and proceedings herein, the court grants defendants’ motion.

BACKGROUND

Plaintiffs brought the present action to determine the proper recipient of profit sharing benefits accrued by the late Donald Zinn. Plaintiff Alice Zinn was Donald Zinn’s first wife.
