Smyder, Judge :

Henry Harper of Pocahontas county made his last will dated February 25, 1856, by which he disposed of all his real *363and personal property.' He was then the owner of valuable improved lands for a considerable distance along the bottom or valley of Knapp’s creek, and also of a large quantity of unimproved mountain land of little value adjoining his improved land and extending along the side of it and for some distance north and beyond his creek land.
