Miller, Judge:

R. G. Trump-and- Margaret, his wife, February 17, 1890, by deed conveyed to C. E. Tolley and Paulina M., his wife, a tract of 460 acres of land in Raleigh county, upon which C. E. Tolley thereafter resided with his wife and children until his death in 1896. While said' deed was joint, the land was paid for by him- individually. By his will, made August 29, 1896, probated November 23, 1896, C. E. Tolley undertook to dispose of this land regardless of the interest of his wife therein.
