Appeal from an order denying plaintiff’s motion for a new trial in an action for damages and for an injunction for unfair competition and infringement of tradename.
Plaintiff seeks to enjoin defendant from using the word “Howard” or the words “Howard Clothes” or any similar name in connection with the sale of men’s and boys’ clothing and furnishings in the city of Minneapolis or at any place within a radius of 100 miles from; Minneapolis and St. Paul, and also prays for damages.
