MEMORANDUM ORDER
SUE L. ROBINSON, District Judge.
I. INTRODUCTION
On November 30, 2000, plaintiff Noel L. Santiago filed this action alleging civil rights violations under 42 U.S.C. § 1983 and violations of his Eighth Amendment right to be free from cruel and unusual punishment. (D.I. 2 at 3) Plaintiff alleges that defendants are also liable for assault arising out of an unwarranted beating that occurred on July 19, 2000. (Id.) Plaintiff seeks compensatory and punitive damages. (Id. at 4)
