I. INTRODUCTION

The matter before the Court is the First Amended Complaint (the “Complaint”) filed by Donald R. Lassman (the “Trustee”) against John J. Reilly, Jr. (“Reilly”), Michael T. Hull (“Hull”), Affordable Funding Mortgage Corp. (‘Affordable Funding”), Richard Costa (“Costa”), and Raymond Kohlman (“Kohlman”). The Court entered a default against Affordable Funding on December 17, 2007 and a default against Hull on January 26, 2010 as Hull failed to appear and defend himself at trial.
