MILLER, District Judge.

This action is before me on the plaintiff’s motion for a temporary injunction, and upon the defendant’s motions (1) to dissolve a temporary restraining order entered without notice at the time of the filing of the action, and (2) to dismiss the complaint.

The action was filed at 11:15 a. m. on Saturday, December 6, 1941, by the plaintiff Thomas Graham, a minority stockholder of the defendant corporation, Tom Moore Distillery Company, and seeks to enjoin the defendant from entering into a contract for the sale of its whiskey with William Jame-son & Co.
