Steinback v. Diepenbrock

Appeal by the plaintiff, Erwin Steinback, from an order of the Supreme Court, made at the New York Special Term and entered in the office of the clerk of the county of New York on the 31st day of March, 1896, denying his motion for an order directing the chamberlain of the city of New York to pay to him certain moneys as required by a decree of the court.

Barrett, J. :
Upon the 23d of October, 1895, after a trial at Special Term, the plaintiff had judgment decreeing that he was entitled to'a sum of money which had previously been deposited with the chamberlain of the city of New York to the credit of this action, and directing the payment to him by the chamberlain of such sum with its accumulations. From that judgment the defendant Diepenbrock appealed to this court where there was an affirmance. From this affirmance the said defendant has since appealed to the Court of Appeals.
