Appeal from the Cass Circuit Court. — Hon. Chas. W. Sloan, Judge. (1) Now, here is a plain, unequivocal contract, between plain till and defendants, with the breach thereof assigned, and damages set forth on account of said breach. If this does not state a good cause of action, then we are unable to know when one is stated. In Stillwell v. Hamm, 97 Mo. 585, Judge Barclay clearly holds that pleadings under the code should not be construed most strongly against the pleader.

This is an action for the recovery of damages for deceit.
