ERVIN, District Judge.
This matter comes on to be heard on a motion filed by the Alien Property Custodian and the Treasurer of the United States to dismiss the bill for want of equity.
The bill is filed under the provisions of section 9 of an “Act to define, regulate and punish trading with the enemy and for other purposes,” commonly known as the “Trading with the Enemy Act (Act Oct. 6, 1917, c. 106, 40 Stat. 419 [Comp. St. 1918, § 3115y2e]).
