MEMORANDUM OPINION
STEPHEN A. STRIPP, Bankruptcy Judge.
This is the court’s decision on a motion by Homeside Lending Inc. (hereinafter “Homeside”) for relief from the automatic stay and for prospective relief so that Homeside can commence eviction proceedings against the debtor. Deborah Manga-no (hereinafter the “debtor”) opposes the motion. The principal issue oh this motion is whether acceptance of postpetition mortgage payments by the mortgagee constitutes waiver of the mortgagee’s right to relief from the automatic stay.
