This cause is before the Court on Defendants’ Amended Motion to Dismiss Plaintiffs Complaint [Docket No. 42], filed on September 20, 2010, pursuant to Federal Rules of Civil Procedure 12(b)(1), 12(b)(6), and 12(b)(7).
