This matter comes before the Court on the motion of defendant Chase Bank USA, N.A., (“Chase”) to dismiss this adversary proceeding, which was commenced by Nigel Anthony Russell (“plaintiff’ or “Russell”), seeking actual and punitive damages against Chase based on allegations that Chase violated the discharge injunction provided by 11 U.S.C. § 524 by intentionally failing to correct erroneous information on Russell’s credit reports in order to collect a discharged debt from him.
