Plaintiff, United Transportation Union (“UTU”), appeals from the district court’s grant of summary judgment in favor of Defendant, Cuyahoga Valley Railway Company (“Cuyahoga”), in this action under the Railway Labor Act (“RLA”). The UTU challenged a decision of a Public Law Board in district court, contending that the Board improperly refused to take jurisdiction over a dispute between the UTU and Cuyahoga.
