This is an appeal by defendants, John K. Wu and his wife Carol Wu, from a directed verdict rendered by the Windsor Superior Court at the close of a jury trial. The judgment was for $35,302 in damages resulting from payment on a performance bond by Fidelity & Deposit Company of Maryland, a surety and bonding company doing business in this state, following the defendants’ breach of a subcontract to perform construction work on a dam project near Goshen, New Hampshire.
