This is an action by the insurance commissioner, suing in trespass, as statutory liquidator 1 of the Penn sylvania Surety Corporation, hereafter called Surety, against a number of defendants, alleged to have been its directors, to recover losses sustained by Surety “by reason”, as the statement avers, “of the negligence and neglect of the defendants and each of them” in the conduct of its business.
