This appeal is from a judgment in favor of the appellee against the appellant for the sum of $5,000 as damages for personal injuries. On the night of June 13, 1911, while the appellee was walking along Elm street in the city of Dallas, and in front of what is called the “Wilson Annex,” a building then in course of construction, she was struck on her right leg by a wheelbarrow approaching from behind, and pushed by a negro employed in removing rubbish from that building.
