OPINION and ORDER

SMITH, Senior Judge.

The Court has before it the parties’ cross-motions for summary judgment on the matter of liability for the alleged taking of Plaintiffs property without just compensation and for an illegal exaction. With its cross-motion, the Defendant filed a Motion to Dismiss Plaintiffs illegal exaction claim for lack of subject-matter jurisdiction. For the reasons set forth below, the Court holds that the Government took Plaintiffs property without just compensation.
