Both of the causes docketed in this Court, Nos. 5960 and 5961 have for their object the same end, namely, the proper interpretation of our so called “good time” statutes and “indeterminate sentence” laws and their true relationship to each other. The case first filed, No. 5960, is a habeas corpus proceeding in which petitioner asks his release and discharge from the custody of Edwin Swope, Superintendent of the State Penitentiary, where it is claimed he is illegally restrained of his liberty.
