MILLER, Associate Justice.

This appeal comes to us from an order of the. District Court dismissing a petition for a writ of habeas corpus and discharging the writ which had been theretofore issued and directed to appellee Rives in his capacity as Superintendent of the Washington Asylum and Jail.

On January 20, 1933, appellant pleaded guilty to the crime of robbery in the Supreme Court (now the District Court of the United States for the District of Columbia) ; was sentenced to serve a term of from two years and seven months to five years; and thereupon was committed to the District of Columbia…
