OPINION
CHIN, District Judge.
Plaintiff Champ Hallett (“Hallett”) brings this action for declaratory, injunc-tive, and compensatory relief alleging that while he was incarcerated in the custody of the New York State Department of Correctional Services (“DOCS”), first in Elmi-ra Correctional Facility (“Elmira”) and then in Green Haven Correctional Facility (“Green Haven”), defendants denied him access to special programs because of his status as an HIV-positive amputee. Hal-lett alleges that these denials violated the Americans With Disabilities Act of 1990, 42 U.S.C. §§ 12101 et seq. (1999)…
