The original judgment of this Court in this case was one of reversal, four of the Justices concurring. The opinion and judgment were handed down on March 15, 1940. The majority opinion was written by Mr. Justice CHAPMAN, concurred in by Presiding Justice WHITFIELD and Mr. Justice BUFORD and this writer. Justices TERRELL and THOMAS did not participate in that decision under Rule 21-A.
