This bid protest is before the court on the parties’ cross-motions for judgment upon the administrative record. Plaintiff asks this court to order the Department of State (“DOS”) to reinstate its pre-qualification for the FY 2007 New Embassy Compounds Design-Build Construction Program (“NEC Program”). Plaintiff alleges that the DOS’s decision to revoke plaintiffs pre-qualification was irrational, arbitrary, and capricious because a decision of the Government Accountability Office (“GAO”), upon which the DOS relied, was contrary to the plain meaning of the statute…
