Appellant was convicted of murder in the second degree and sentenced to ten years' imprisonment in the penitentiary for having shot and killed one Arthur Marshall at Sikeston, Scott County, Missouri, on the night of September 25, 1929. This is the second appeal. On the first trial, held in the Circuit Court of Scott County, appellant was convicted of murder in the second degree and sentenced to twenty years' imprisonment.
