Claude Jones was charged with having committed-a burglary in the second degree and larceny in Audrain County, Missouri. The larceny charge was dismissed at the close of the State’s case because of a defect in the information with respect to said charge. The jury found defendant guilty of the burglary and assessed his punishment at two years’ imprisonment. §§ 560.045, 560.095, RSMo 1949.
