This cause was submitted to and decided by Division B of the court. On that hearing the decree of the court below was affirmed. Thereafter a suggestion of error was filed by appellant, followed by an order entered, setting aside the judgment of affirmance, and remanding the cause to the docket for consideration and decision by the court en banc. The court enbanc, after argument and consideration, adopts the opinion handed down by Division B, and in addition the following opinion.
