On October 24,1933, in Yamhill county, Oregon, the plaintiff, while riding in an automobile operated by defendant and as the latter’s guest, re ceived permanent injuries as a result of the car’s overturning, due to the negligent and careless operation of the same by the defendant.

The sole question involved on this appeal is whether or not § 55-1209, Oregon Code 1930, commonly known as the guest statute, is unconstitutional. This section of the code was passed in 1929 [Laws 1929, chapter 401, § 1], and is as follows:
