The original action in the trial court was instituted by Pollock Investments, Inc. against Guaranty Bond State Bank and American Standard Investment Company, Inc., in which the plaintiff sought to recover judgment based upon a guaranty or purchase agreement executed by Guaranty Bond State Bank, by and through its president, Charles A. Tucker, agreeing to purchase a certain promissory note executed by one Wayne McPeters to American Standard Investment Company in the sum of $100,000, said note subsequently having been assigned to Pollock Investments, Inc.
