OPINION and ORDER

TURNER, Judge.

Plaintiff challenges his involuntary separation from the United States Army. The case is before the court on defendant’s motion to dismiss the complaint for lack of jurisdiction or, in the alternative, for summary judgment. For the reasons given below, we conclude that plaintiff’s complaint is within the court’s jurisdiction. We further conclude that under the appropriate standard of review—whether the discharge decision was arbitrary, capricious, in bad faith, unsupported by substantial evidence or contrary to law, regulation or published procedure—there is no…
