The question presented on this record for discussion, arises on the validity of the promise of the deceased, Henry Cook, stated in the bill. If no action can be supported on that contract, then the interference of the court to exercise its chancery power, to explain or invalidate the discharge, would be useless ; and the examination of other points suggested in argument, unnecessary I am satisfied, on a full view of the case, that the contract is void, for want of consideration ; and therefore, that no action can be supported on it.
