Plaintiffs The Nation magazine and Max Holland, a contributing editor to The Nation, commenced this action on October 14, 1992 by filing a complaint which alleges that defendants have violated the Freedom of Information Act (“FOIA”), the Administrative Procedure Act (“APA”), and the First Amendment by denying expedited access to federal records concerning independent Presidential candidate H.
