Proceeding pursuant to CPLR article 78 (transferred to this court by order of the Supreme Court at Special Term, entered in Albany County) to review a determination of respondent Superintendent of State Police which dismissed petitioner from his position as a State trooper.

Petitioner, a State trooper since October 1981, was dismissed by respondent Superintendent of State Police following a disciplinary hearing and a finding sustaining three charges involving the misuse of his gun.
