Ralph Levato was convicted of obtaining money by means of the confidence game and prosecutes this writ of error to review the judgment.
The testimony of the prosecution tends to show the following facts: Between two and four o’clock in the afternoon of September 11, 1926, after the banks were closed, the plaintiff in error and Roy Wall, in the store of Tebbetts & Garland, showed an identification card to Frances Schumacher, a switch-board operator on the first floor, and asked her to O'.
