COVINGTON, District Judge.

This matter comes before the Court pursuant to Defendants’ Consolidated Motion to Dismiss Individual Defendants, Motion to Substitute, and Motion to Dismiss Com plaint, or in the Alternative, Motion for Summary Judgement and Incorporated Memorandum of Law (Doc. # 23), filed on March 11, 2005. As of the date of this Order, Plaintiff has failed to file a response in opposition to the instant motion. 1
