Ripley v. Lanzer

Court of Appeals of Washington

Decided September 14, 2009No. 61952-7-IPublishedCited by 15 opinions

1Opinion of the CourtCox, J.

¶1 Katherine and Daniel Ripley, husband and wife, appeal the summary dismissal of their medical malpractice claims against Dr. William Lanzer, MD, and Evergreen Medical Center and its employees (collectively Evergreen).1 Because the doctrine of res ipsa loquitur applies to their medical malpractice claims against Dr. Lanzer and Evergreen, the Ripleys were not required to provide expert medical testimony in response to the summary judgment *302motions of these defendants. There are genuine issues of material fact for trial. Summary dismissal of the medical malpractice claims was improper.
