Foster, as treasurer of said county, to enjoin and restrain him, as' such officer, from paying over to the State the money apportioned to said county for state revenues for the year 1908. The defendant demurred to the complaint and same being overruled, a decree was rendered in favor of plaintiff, from which decree defendant appeals. Statement by Mr. Justice Bean.
