Presently before the Court is Defendant Paul Ware’s motion for summary judgment on the plaintiffs claims. (Doc. 43.)

This action arises out of the events allegedly taking place on May 13, 2008. In her complaint, Bridget Festa alleges she was in her car, pulling away from her home in Scranton, Pennsylvania, when she noticed Dunmore police cars following her.
