BOGGS, Circuit Judge.

The plaintiffs in this action seek money damages from the Ohio Civil Rights Commission (“Commission”) for violation of the Fair Labor Standards Act (“FLSA”). In light of Seminole Tribe of Florida v. Florida, — U.S. -, 116 S.Ct. 1114, 134 L.Ed.2d 252 (1996), we hold that the part of the FLSA that purports to give federal courts jurisdiction over an action against a state for viola tion of the FLSA’s minimum wage and maximum hour provisions is unconstitutional and, therefore, the district court was without jurisdiction over the plaintiffs’ case.
